Transfer Fees, also called Resale Fees, Document Fees, Disclosure Fees or Demand Fees are generally charged to a home seller to cover the costs associated with transferring property in an HOA.

These fees pay for certifying that the property is in compliance with CC&R’s and other governing documents. The fees pay for the delivery of all governing documents to the new owner and help cover any liability associated with the process.

Many communities are unaware that state law permits the association to set the fee amount.  This leaves the management company in total control over setting what they think a reasonable fee should be. Any and all liability for the handling of this process, however, remains with the community.
